1. What this policy is
This policy sets out what the PayAngel service may and may not be used for. It applies to the PayAngel app and the PayAngel Australian website, and it forms part of your agreement with us under our Terms and Conditions. Clause 9 of those terms summarises it; this policy sets it out in full.
The service is provided by PAYANGEL PTY LTD (ABN 13 685 159 497, ACN 685 159 497), registered with AUSTRAC as an independent remittance dealer, registration number IND100902318-001.
This policy applies to our Australian service only. Other companies using the PayAngel name operate in other countries under other rules.
2. What our service is for
PayAngel Australia is for individuals sending their own money from Australia to a beneficiary in a country we support, for personal, family or household purposes. That is the whole of it. Anything outside that is outside this policy, and outside what our AUSTRAC registration covers.
3. What you must not do
Unlawful activity
You must not use our service:
- in breach of any law;
- to launder money, to finance terrorism, to finance the proliferation of weapons, or to evade tax;
- to support or finance any unlawful activity, including trafficking, bribery or extortion.
Fraud and deception
- Impersonating another person or organisation.
- Giving us information that is false, inaccurate, misleading or incomplete, whether when you open an account or when you instruct a transfer.
- Giving us documents that are not genuine.
- Using a payment method, card or credentials that are not yours or that you are not authorised to use.
Money that is not yours
- Sending money that belongs to someone else, or sending on behalf of another person.
- Funding a transfer from a payment method that is not held in your own name.
- Opening more than one account, or letting anyone else use your account.
We check the name on the payment method against the name on the account. A mismatch is a breach of this policy, not an administrative problem.
Business use
- Using the service for any business, commercial or investment purpose.
- Using it on behalf of a company, association, not-for-profit, trust or other organisation.
Our service is not designed or offered for those purposes. If that is what you need, we are not the right provider.
Restricted financial activity
You must not use our service to make or receive payments for:
- illegal gambling or betting;
- unlicensed money transmission or any form of informal value transfer;
- Ponzi schemes, pyramid selling or high-yield investment programmes;
- unregistered securities, or investments we are not licensed to support;
- anything else that is unlawful to buy or sell.
Sanctions
You must not use our service to send money to, or for the benefit of, a person, organisation or country subject to Australian sanctions. Australian sanctions are imposed under the Charter of the United Nations Act 1945 (Cth) and the Autonomous Sanctions Act 2011 (Cth), and the designated persons and entities are listed on the Consolidated List maintained by the Department of Foreign Affairs and Trade. We screen against that list.
Destinations we do not support
You must not attempt to send to a country outside the destinations we support. The current
list is in clause 5 of our Terms and Conditions. It
is set by our own risk assessment and it changes.
Abuse of our systems
- Getting around, or trying to get around, our security controls.
- Gaining or attempting to gain unauthorised access to any of our systems, networks or accounts.
- Using bots, scrapers or other automated tools against our service.
- Denial-of-service attacks, malware, spyware or anything similar.
- Interfering with another customer’s use of the service.
Content
- Sending offensive, violent, abusive, harassing or discriminatory material through our service, including in a payment reference or message field.
- Infringing anyone’s intellectual property rights.
4. What we are required to do
We are a reporting entity under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). That means we are required to verify who you are, to monitor transactions, to screen against sanctions lists, and to report certain matters to AUSTRAC. We are also required to keep records.
These are our obligations, not yours. We set them out so you understand why we ask what we ask, and why a transfer is sometimes delayed while we complete a check.
5. What happens if you breach this policy
Depending on what has happened, we may:
- ask you for more information;
- delay, refuse, hold or reverse a transfer;
- suspend your account, or close it;
- report the matter to AUSTRAC, to the police or to another authority; or
- take legal action.
Where we cannot tell you why
There are situations where the law does not permit us to give you the reasons for a decision. Section 123 of the AML/CTF Act makes it an offence to disclose certain matters. Where that applies, we will tell you the outcome and say plainly that we cannot explain it. We will not give you a different reason instead.
Loss we suffer
You are responsible for loss we suffer because you breached this policy, but only to the extent the loss was caused by the breach and was reasonably foreseeable. Nothing in this policy limits the rights Australian law gives you that cannot be excluded — clause 11 of our Terms and Conditions sets those out.
6. Telling us about a problem
If you think someone is misusing our service, or that something has gone wrong with your account, please tell us. You do not have to, and nothing happens to you if you do not — but the sooner we know, the more we can do.
Report suspected misuse to compliance.au@payangel.com.
If you think your account has been accessed by someone else, tell us immediately through the app. Do not wait to send an email.
7. Changes to this policy
We may change this policy. If a change is not to your advantage, we will give you at least 30 days’ notice before it takes effect, and you may close your account before then at no cost.
We may make a change sooner where it is neutral or to your advantage, where the law requires it, or where we are legally obliged to impose a new restriction. We will tell you when we do.
This matches clause 14 of our Terms and Conditions. The two cannot differ, because this policy forms part of the same agreement.
